1. Acceptance of Terms & Account Registration

By accessing and using Vanguard Servers services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. When registering an account, you are strictly required to provide your real, accurate name, billing address, email address, and phone number. We reserve the right to request verification of this information at any time, and providing fake or inaccurate details may result in immediate account suspension or termination.

2. Service Provision

Vanguard Servers provides various hosting services including, but not limited to, web hosting, VPS, dedicated servers, and domain registration. We reserve the right to modify or discontinue any service with proper notice to our clients.

3. Acceptable Use Policy

Clients are prohibited from using our services for illegal activities, distributing malware, sending spam, or engaging in DDoS attacks. Any violation may result in immediate suspension or termination of your account without a refund.

4. Billing and Refunds

We offer a strict 24-hour full refund policy for new services. To accommodate fraud prevention and purchase verification, this 24-hour window strictly begins only after your server has been fully activated and provisioned, not at the time of checkout. Please note that we do not offer free trials. We reserve the right to refuse any refund request within the 24-hour window if the service was abused, or if it is determined that the service was purchased without the genuine intention of maintaining a subscription (e.g., using the 24-hour window to temporarily host an official project). After this initial 24-hour active period, all payments are strictly non-refundable. Invoices are generated prior to the billing period, and failure to pay may result in service interruption.

5. Limitation of Liability & Cap on Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VANGUARD SERVERS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, LOSS OF GOODWILL, SERVICE INTERRUPTIONS, OR DOWNTIME RESULTING FROM THE USE OF OR INABILITY TO USE OUR SERVICES.

IN NO EVENT SHALL VANGUARD SERVERS' AGGREGATE TOTAL LIABILITY FOR ALL CLAIMS, DISPUTES, OR DAMAGES OF ANY KIND (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO VANGUARD SERVERS FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE BILLING PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY.

TO THE EXTENT PERMITTED BY LAW, ANY LEGAL CLAIM, CAUSE OF ACTION, OR DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE, OR BE PERMANENTLY AND FOREVER BARRED.

We highly recommend that all clients maintain their own off-site backups. For your convenience and peace of mind, we offer affordable backup solutions that can be added to your service if required.

6. Acceptable Use and Suspensions

Vanguard Servers strictly prohibits the use of cracked plugins, illegal software, cryptocurrency mining, or any actions that harm or compromise the data of other users. If it comes to our attention that your project or server is engaging in these activities, your services will be terminated immediately without a refund.

7. Billing Cycle

Our standard billing month is defined as every 28 days. To ensure uninterrupted service and for your convenience, invoices may be generated and sent via email prior to the due date, encouraging early payment to save time. Additionally, automatic charges may be processed up to one day before the official due date to prevent any accidental service interruptions or late fees.

8. Support and Response Times

We strive to provide fast and efficient support. Our standard support operating hours are Monday through Friday, 9:00 AM to 5:00 PM Eastern Standard Time (EDT/EST). During these business hours, ticket response times generally range from 1 to 8 hours depending on the status and priority level of the ticket. We are officially closed for general support on weekends (Saturday and Sunday). However, at our sole discretion, we may make exceptions and provide weekend support for specific orders if it was previously disclosed and agreed upon that deployment or critical action would occur during that time.

9. AI-Powered Tools, Web Builder, and Support

Vanguard Servers provides AI-driven tools, including automated support, server performance analytics within game server panels, and an AI Website Builder for web hosting services. By using any of these features, you consent to the processing of relevant prompts, server metrics, support queries, and site generation inputs by our AI systems to deliver these tools.

All AI-generated outputs—including but not limited to website content, code, layouts, graphics, performance recommendations, and support responses—are provided strictly on an "as is" and "as available" basis. Users are solely responsible for reviewing, verifying, and testing all AI-generated content, code, or layouts before publishing or relying upon them. Vanguard Servers assumes no liability for errors, inaccuracies, copyright issues, broken scripts, or actions taken based on AI-generated output or recommendations.

10. Governing Law and Choice of Forum

These Terms of Service, your use of Vanguard Servers services, and any disputes, claims, or legal proceedings arising out of or related thereto shall be governed by, interpreted, and construed in accordance with the laws of the State of Georgia, United States, without giving effect to any choice of law or conflict of law principles.

For any legal action, lawsuit, or dispute arising within the United States or brought against Vanguard Servers, you expressly agree that exclusive jurisdiction and venue shall lie solely in the state or federal courts located within the State of Georgia. You hereby consent and submit to the personal jurisdiction of such courts and irrevocably waive any objection based on improper venue, forum non conveniens, or inconvenient forum.
